Criminal Code And Child Pornography Charges

Child pornography charges involve photographic, film, video or other types of visual representation where a person is, or depicted as, someone under the age of 18. These charges can also involve someone who is engaged in (or depicted as being engaged in) sexual activity with someone who is under the age of 18, or dominant characteristics involving the sexual organs or anal regions of a person under the age of 18.

Child Pornography Punishments

Persons who possess child pornography could face punishments of imprisonment for up to five years. The charge of making child pornography “available” carries a punishment on indictment of 10 years of jail and a minimum punishment of a year, with the minimal summary conviction penalty being 90 days. The punishments for other related offences are similar and also serious. Suspended sentencing (like or conditional sentences) is not available for many offences involving child pornography.

Peer-To-Peer Internet Sharing Programs

Cases involving child pornography will frequently relate to the use of a computer, more specifically Internet sharing programs such as GigaTribe, Lime Pro, LimeWire, FrostWire and more. These utilize file-sharing programs in which files can be swapped and downloaded. If police find evidence of child pornography on your computer, forensic tools can be used to extract that material.
